Sponsor is CaptionMax, 2438 27th Ave S, Minneapolis, Minnesota, 55406, USA (“Sponsor”).


Term

The 2016 CaptionMax Description Contest (“Contest”) begins May 1, 2016, 9:00 a.m. United States Eastern Standard Time (“EST”) and ends May 31, 2016, 11:59 p.m. EST. Information on how to enter and prizes form part of these official rules (“Official Rules”).


Eligibility

Contest is open only to individuals who reside in the United States and have reached the age of majority in their state of residence at the time of Entry. The following individuals are not eligible to participate: (a) employees of CaptionMax and employees’ immediate family, (b) independent contractors of CaptionMax and independent contractors’ immediate family, (c) professional describers, as any individual who has received compensation in exchange for describing videos, films, or performances of any kind, and (d) previous winners of the CaptionMax Description Contest.


How to Enter

To enter, visit www.videodescriptioncontest.com and complete an entry form with the required information, including your name, address, telephone number, email address, and completed description text in accordance with the instructions that follow (“Entry”). Each Entry must contain the text description, in English, in the text box indicated. The text description, in its entirety, must be a single work of original material written by the entrant. The text description must not, in the sole and unfettered discretion of the Sponsor, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. Video description should include the information that is most important for a blind or low-vision viewer to understand a film or television program. The goal is to convey as much visual content as possible by augmenting the dialogue and soundtrack. The best description will harmonize with the existing audio to create a seamless experience for the audience. This is a skill-based contest, and chance plays no part in the determination of winners.

All Entries must be submitted online and must be received before 11:59 p.m. EST on May 31, 2016. Proof of submission is not proof of receipt. Only one Entry is allowed per person. If more than one Entry is submitted by the same person, only the first eligible Entry submitted will be considered. All Entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for any computer hardware or software failure or for lost, late, stolen, incomplete, illegible, inaccurate, undeliverable, delayed, or misdirected Entries. Odds of winning will depend on the number of eligible Entries received.


Contest Prizes

The first place winner will receive US $2,000; the second place winner will receive US $1,000; the third place winner will receive US $500. Winning descriptions will be published on the CaptionMax websites, emails, and social media sites.


Judging

All eligible Entries will be scored by a panel of description professionals (“Judges”) who will award points based on the following equally weighed criteria (“Judging Criteria”): (1) relevance of details, (2) clarity of description, (3) vividness of language, (4) consistency of mood, and (5) timing and readability. The Entry with the highest cumulative score will win first place, the second and third highest scoring Entries will take second and third place prizes respectively. In the event of a tie, the tied Entries will be resubmitted to the Judges for a rejudging between the tied Entries alone based on the Judging Criteria.


Winner Notification

Winners will be chosen on or around July 15, 2016, and notified by the email and phone number provided in Entry. Winners will be required to execute and return an affidavit of eligibility within ten (10) days of notification which will include granting Sponsor a nonexclusive license to reproduce, distribute, display, and create derivative works of the Entry, along with a name credit, in connection with this Contest and any future promotions of Sponsor without additional compensation as allowed by law (the “Affidavit”). In the event that the selected winner(s) of any prize is/are ineligible, cannot be traced, does/do not respond to a winner notification as required above, or refuses the prize, the prize will be forfeited and Sponsor will award prize to another entrant based on the Judging Criteria as described in these Official Rules.


Conditions of Participation

Participation in Contest constitutes entrant’s agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. By entering Contest, entrant represents, acknowledges, and warrants that the submitted text description is an original work created solely by the entrant and that the text description does not infringe on any property right, copyrights or trademarks of another. All participants with winning Entries agree to grant Sponsor a nonexclusive license to reproduce, distribute, display, and create derivative works of the Entry (along with a name credit) in connection with this Contest and any future CaptionMax promotions without additional compensation, to the extent permitted by law.

All federal, state, and local taxes, fees and surcharges and taxes on prizes are the sole responsibility of the prizewinners.

The Sponsor reserves the right to verify the validity and originality of any Entry and/or entrant (including an entrant’s identity and address) and to disqualify any entrant who is excluded by the Official Rules or who submits an Entry that is not in accordance with the Official Rules or who tampers with the entry process or administration of Contest. If, for any reason, the fairness or integrity of Contest becomes compromised, Sponsor reserves the right to suspend, modify, or terminate Contest.

Entrants are responsible for complying with these Official Rules. Winners’ names will be available online at www.videodescriptioncontest.com after July 15, 2016.


Limitation of Liability

By entering this Contest, all entrants agree to release, discharge, and hold harmless CaptionMax and its employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in this Contest.


Data Privacy

Entrants agree that personal data, especially name and email, may be used for the purposes of this Contest and Sponsor’s ongoing promotional activity. The data may also be used by the Sponsor in order to verify the participant’s identity, postal address, and telephone number or to otherwise verify the participant’s eligibility to participate in Contest. Any individual may elect to unsubscribe from Sponsor’s list by email or by submitting a removal request in writing to: CaptionMax, 2438 27th Ave S, Minneapolis, MN 55406.


Waiver

Failure by the Sponsor to enforce any of its rights at any stage does not constitute a waiver of those rights.
